These Terms of Service ("Terms") govern your access to and use of The Weiser Cabinet mobile application, website, and related services (collectively, the "Service"), operated by Philip Weiser, doing business as The Weiser Cabinet ("we," "us," or "our"). By accessing or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to create an account or subscribe to the Service. Household members of any age may use the Service under an account held by an adult. By creating an account, you represent and warrant that you meet this requirement and that your use of the Service complies with all applicable laws and regulations. We reserve the right to terminate access for any account holder who misrepresents their eligibility.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a device you own or control, solely for your personal, non-commercial household use.
This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Service or any portion of it. All rights not expressly granted are reserved by us.
The Service, including its source code, object code, architecture, algorithms, database schemas, consumption intelligence methodology, replenishment engine logic, user interface design, visual themes, trade dress, and all associated documentation, is and remains the exclusive intellectual property of The Weiser Cabinet. Nothing in these Terms transfers any ownership interest to you.
"The Weiser Cabinet" name, logo, and associated marks are proprietary identifiers of our Service. You may not use them without our prior written permission.
Any feedback, suggestions, or ideas you submit regarding the Service may be used by us freely, without obligation, attribution, or compensation to you.
You agree that you will not, directly or indirectly:
Your use of the Service involves the collection and storage of household consumption data, including but not limited to barcode scans, product identifications, and usage patterns ("Household Data"). Your Household Data is partitioned to your household and is not sold to third parties in individually identifiable form.
We reserve the right to analyze, aggregate, and derive intelligence from usage data across the Service, including anonymized and de-identified forms of Household Data, for the purposes of improving the Service, developing new features, understanding consumption trends, and supporting our business operations. Such aggregate intelligence is our proprietary work product and does not constitute a disclosure of your individually identifiable information.
You may request export or deletion of your Household Data by contacting us at the address below. We will honor such requests within a reasonable time. Deletion of your data will result in termination of your account and access to the Service.
Our Privacy Policy, available at theweisercabinet.com/privacy, is incorporated into these Terms by reference. In the event of any conflict between these Terms and the Privacy Policy regarding data practices, these Terms control.
Access to the full Service requires a paid subscription, which is processed exclusively through Google Play. All billing, refund, and cancellation terms are governed by Google Play's policies. We do not collect or store payment card information.
New accounts may be eligible for a free trial period as specified at the time of registration. At the conclusion of the trial, your subscription will auto-renew at the applicable rate unless cancelled through Google Play prior to the renewal date.
We reserve the right to modify subscription pricing at any time. Price changes will take effect at your next renewal cycle following reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any data or outputs generated by the Service will be accurate or complete. Replenishment recommendations and consumption analysis are provided for informational convenience only and are not a substitute for your own judgment.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE WEISER CABINET, ITS OWNER, OR ANY AFFILIATED PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless The Weiser Cabinet and its owner from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms, with or without prior notice. Upon termination, your license to use the Service immediately ends.
Sections 3, 4, 5, 7, 8, 9, and 12 of these Terms survive any termination or expiration.
We reserve the right to modify these Terms at any time. When we do, we will update the Effective Date at the top of this page. Your continued use of the Service following any modification constitutes acceptance of the revised Terms. If a modification is material, we will make reasonable efforts to notify you through the app or via the email address associated with your household account.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction in those courts.
You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Weiser Cabinet regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
